Clackamas County Circuit Court Judge Kathi Steele issued a general judgment Monday, March 3 requiring the city of Lake Oswego to remove barriers and create the conditions for safe public access to Oswego Lake from Millennium Plaza Park in the next four months — along with declaring that the waters and bed of the lake are public.
The judgment could end at least this iteration of the legal saga over lake access that started in 2012 when plaintiffs Mark Kramer and Todd Prager filed a lawsuit asserting that the city of Lake Oswego’s policies preventing access from its lakefront properties (which include Millennium, Sundeleaf Plaza and Headlee Walkway) violated the state’s public trust doctrine.
