PORTLAND Ore. (KPTV) – A Portland couple was sentenced Friday to more than four and six years in prison, respectively, after their then-3-year-old son suffered a brain injury due to a fentanyl overdose, the Multnomah Co. District Attorney’s Office announced Sunday.
According to the DA’s office, the couple’s plea agreements allowed Samantha Faye Smith and Delone Dominque Kelley to remain out of custody before their sentencing to get their affairs in order. Both Kelley, 32, and Smith, 29 had pled guilty to first-degree criminal mistreatment and third-degree assault.
Police said the 3-year-old ingested fentanyl at the family’s apartment on Southeast Powell Court in June 2023 and suffered a non-fatal fentanyl overdose that caused a severe brain injury.
