South Portland tenant sues city over ‘weaponized’ noise by protesters at ICE facility

PORTLAND, Ore. (KOIN) — A tenant at a low-income apartment complex located near the Portland ICE facility is suing the city, alleging that police failing to enforce noise laws has caused adverse affects on her health and safety amid continued protests in the area.

The suit claims that, since protests began outside the ICE facility in February, protesters have repeatedly engaged in “non-protected speech activity,” such as the use of bullhorns and other sound amplification devices at “all hours of the day and night,” when city Title 18 Noise Control Code states quiet hours are generally between 10 p.m. and 7 a.m.

The tenant’s “weaponized” noise concerns came to a head on June 28, with her claiming to hear “sounds of shrill, high-pitched buzzers and bells, screeching and piercing whistle-type sounds, sounds that mimic air raid warning sounds — the type of which might be used to give notice of a nuclear bomb was being launched and headed in one’s direction,” the suit alleges.

The following morning, the tenant said she felt blood coming from her ear, believing the noise burst her eardrum…
