Livestream: Karen Read’s lawyers make dismissal arguments before SJC

Read’s lawyers will appeal to the state’s highest court Wednesday in a bid to dismiss two of her charges.

’s lawyers will make their pitch to the state’s highest court Wednesday, arguing that two of Read’s charges should be dropped after jurors in her first trial allegedly agreed internally to acquit her of second-degree murder and leaving the scene of a fatal accident.

Read, 44, is accused of drunkenly and intentionally striking her boyfriend — Boston Police Officer John O’Keefe — with her SUV and leaving him to die on a snowy lawn in Canton on Jan. 29, 2022. Read’s lawyers maintain she was framed in a widespread coverup.

Her first trial resulted in a mistrial July 1 after jurors told Judge Beverly Cannone they were deadlocked.

However, it wasn’t long before several jurors began reaching out to lawyers on both sides, purportedly claiming the jury had actually decided to acquit Read on two of her three counts prior to Cannone’s mistrial declaration. Cannone denied a defense motion to dismiss those two charges or conduct a post-trial hearing to confirm the jurors’ reports, and Read’s lawyers are now appealing to the Supreme Judicial Court.
