‘Cake Pop Bill’ is making its way through the Virginia General Assembly

Three months ago, Kelly Phillips was warned by Virginia officials that selling bite-sized cake pops out of her house was forbidden.

This week, the Virginia House of Delegates voted 94-2 to pass HB 759. That will grant more freedom to Phillips and others who sell homemade goods out of their homes. They will not break the law by doing so.

Phillips, who runs KP’s Kake Pops out of her home in the Richmond area, said:

“I am still in shock, obviously, that cake pops are such a huge discussion.”

House Bill 759 which initially dealt with homemade pickles was modified to address Phillips’ business.

Safety inspection rules don’t apply to low-risk foods like baked goods, jellies, nuts, and pickles produced in home kitchens, as long as they’re sold directly to customers out of the producer’s home or at a farmer’s market. However, uninspected goods cannot be sold online.

Delegate Nick Freitas, R-Culpeper presented the bill that was approved in the House of Delegates to raise the cap from $3,000 in gross sales to $9,000.
