Judge denies former prison guard’s request to withdraw guilty plea in Robert Brooks’ death

UTICA, N.Y. — A former prison guard is trying to withdraw his guilty plea in the death of Robert Brooks, the Greece man who was beaten at Marcy Correctional Facility.

David Walters pleaded guilty to second-degree manslaughter in September in Oneida County Court. Our Syracuse NBC affiliate reports that a judge denied an attempt to withdraw that plea.

In total, 10 guards were indicted in Brooks’ death. Walters’ attorney argued that his client’s charge differed from what the judge presented to the jury during the trial of three other former officers in the Brooks case. In October, one former guard was found guilty of murder and manslaughter and two others were acquitted of all charges in Brooks’ death…
