NLRB Finds Hoffmann Brothers Policies Violated Labor Law

The National Labor Relations Board has ruled that Hoffmann Brothers violated federal labor law by maintaining overly broad confidentiality policies, in a case brought by Sheet Metal Workers Local 36.

The case, 14-CA-344872, was filed June 21, 2024, after a former employee contacted Hoffmann Brothers workers in April and May 2024 about potential union opportunities. The company responded on June 3, 2024, by sending a cease-and-desist letter citing obligations under a previously signed non-compete and confidentiality agreement.

The union filed an unfair labor practice charge, later amended in February 2025. The NLRB’s regional office issued a complaint May 30, 2025, and the case proceeded to a hearing on Sept. 23, 2025, in St. Louis before an administrative law judge…
