Jury: Not Mall of America, Sea Life’s fault when 6-year-old fell from escalator

BLOOMINGTON, Minn. — A jury has found the Mall of America and Sea Life were not negligent when a 6-year-old fell 30 feet from an escalator in 2019.

A lawsuit was filed in 2022 against the Bloomington mall and aquarium, stating the child was with his father and brother on Feb. 18, 2019, when the accident happened. Court records say the child grabbed the moving escalator handrail to peer over to see the aquarium below, but when he grasped the handrail, his body “got pulled over the wellway railing,” causing him to lose his grip and fall about 30 feet to the ground.

According to the lawsuit, the incident caused the child “pain and suffering, brain damage, damage to the endocrine system, loss of enjoyment of life, emotional distress, and other damages. In addition, [the child] will suffer loss of earning capacity as he becomes old enough to enter the work force, and he will incur lifelong medical expenses because of his injuries.”…
