UTAH COUNTY, Utah (ABC4) — The Utah Court of Appeals has reversed a lower court’s decision to dismiss a lawsuit against Unified Police Department under the basis of governmental immunity. The lawsuit arose from a traffic incident between a UPD officer and two citizens and is set to be further considered.
UPD Officer Ethan Andrus reportedly collided with Armando Ayala and Ashlie Mauger at the intersection of 7000 S and 1300 W while responding to a call in August 2020. The victims sued Andrus and UPD, though the lawsuit was dismissed through summary judgment.
On September 11, the Utah Court of Appeals reversed the summary judgment and have remanded the case back to the lower courts for further proceedings…
