BOUNTIFUL, Utah (ABC4) — A Bountiful father has been charged with custodial interference after he allegedly took his 5-year-old son, of whom he did not have custody, from the child’s mother.
Benjamin Despain, 45, has been charged with one count of custodial interference, a Class B misdemeanor.
According to the Department of Public Safety, Despain’s father picked him up at his mother’s home in Bountiful at 5:30 p.m. on Tuesday, Dec. 2, for visitation hours. When the mother went to pick James up afterwards, Benjamin and James were not at Benjamin’s residence in Murray. Benjamin’s car and the trailer were not at the residence either…
