On March 25, 2022, a Bexar County homeowner recorded a sworn affidavit claiming she was the sole owner of the private road she shared with her neighbors. For one couple who lives on it, that road is the only way in to their house. The neighbors sued, and in January 2023 she revoked the affidavit and dropped the claim. A jury found her liable anyway for filing a fraudulent claim against real property, and the judgment held on appeal.
The road runs in front of her lot and that couple’s lot, and behind the back gates of two other couples, court records show. That couple have lived there since their house was built in 2001.
Her affidavit said she had “exclusively occupied and used” the road since July 30, 2000, and had claimed it as her own, “inconsistent with and hostile to the claims of all others.”…
