San Francisco Secures $3 Million Settlement to Enforce Local Ban on Flavored Tobacco Sales

On October 24, 2025, San Francisco City Attorney David Chiu announced a legal settlement with several online tobacco retailers. The city reached an agreement for nearly $3 million with Rogue Holdings LLC, Swisher International, Inc., and Northerner Scandinavia, Inc. The settlement follows a 2024 lawsuit. The city alleged that these companies violated San Francisco’s ban on flavored tobacco products by selling flavored nicotine pouches, including the ZYN brand, to local consumers.

The judgment requires the companies to take steps to prevent further sales in San Francisco. They must display warnings on their websites stating that flavored tobacco products cannot be sold in the city. They are also required to block San Francisco addresses in shipping and billing fields. The settlement includes a payment of $2,985,000 in civil penalties and attorneys’ fees.
