Deadly Marin crash: Case against teen driver could hinge on key piece of evidence

An attorney representing the teenager who prosecutors said was driving the car in a crash last year that killed four teens asked a Marin County judge to dismiss the case, claiming a key piece of evidence used in the investigation was improperly handled and therefore unreliable.

The teen’s attorney, Charles Dresow, filed a motion Wednesday arguing that the CHP sergeant who investigated the crash removed essential evidence – debris and scuffing – during his analysis of the vehicle’s frozen speedometer, and by doing so made his conclusions about her speed unreliable. The case should be dismissed as a result, Dresow said.

The motion was filed confidentially because the case was unfolding in juvenile court, but Dresow confirmed the subject of the motion with the Chronicle. The teenager is not being named because of the Chronicle’s policy not to name juveniles involved in criminal proceedings…
