VENICE — Three South County residents accused of DUI are the beneficiaries of a Second District Court of Appeal ruling on Friday.
The court denied the state’s attempt to overturn an order by Circuit Judge Erika Quartermaine granting a motion to suppress the use of the results of blood-alcohol tests in their cases. None of the cases has gone to trial yet.
Robert Kilburn and Holly Marano, of Venice, and Arthur Depauw, of North Port, were all arrested for DUI in 2023 and, post-arrest, were subjected to testing using the same Intoxilyzer 8000 machine…
