Civil lawsuit filed against West Congress Street businesses after fatal shooting

An attorney for the daughter of the United States Marine Corps Sergeant who was shot and killed on Aug. 30 at Octane Bar and Lounge filed a civil lawsuit against multiple businesses that operate on West Congress Street, a popular partygoing spot for tourists and Savannahians alike.

The suit, filed in Chatham County State Court on behalf of the 12-year-old daughter and the mother of the daughter, alleges that the businesses were, “in and around the killing fields of the northwest corner of Whitaker and Congress Street,” and were “aware of the heightened risk of criminal activity in that area, to include assaults, batteries, robberies, and homicides.”

Named in the suit are multiple defendants, including Octane Bar and Lounge, Kay’s Pizza, Smoke & Vape Market , and Flock to the Wok and Peacock Lounge . Also named in the suit are multiple owners of Congress Street properties including the owner of Kay’s Pizza, the owner of Smoke & Vape Market, the owner of the building that operates Flock to the Wok and Peacock Lounge, and the owner of the 117 West Congress Street parking lot. A foreign profit corporation that oversaw security and the collection of payment for the Congress Street Lot was also named as a defendant in the suit.
