A man, who police said fatally shot a father in front of his two children during an apparent road rage incident at a Tempe intersection, will not be tried for his death following a grand jury’s decision.
Dustin Alan Jackson, 46, was initially booked on first-degree murder and drive-by shooting charges in the July 1 shooting death of Steven Bevan, according to court documents. But the grand jury declined to indict Jackson on homicide or weapons charges and instead indicted him on possession or use of narcotic drugs and possession of use of drug paraphernalia, according to the Maricopa County Attorney’s Office.
Jackson told police the incident unfolded when he honked while at a green light behind Bevan’s Dodge Challenger, who proceeded to swerve toward his GMC Sierra on the road and sped past him and made a full stop in front of the pickup, according to court documents.
