Case against former massage therapist declared mistrial

SIOUX FALLS, S.D. (KELO) — After deliberating for more than a day, the jury in the case against Kurt Smit did not come to a unanimous decision.

Smit is accused of two counts of sexual contact without consent. Three women testified saying Smit touched their breasts and private parts when giving them a massage in 2024. Two of the women decided to file charges.
