Judge denies self defense claim in Tea murder case

SIOUX FALLS, S.D. (KELO) — The murder trial for a Tea man will move forward. In September, lawyers for Timothy Overton asked a judge to dismiss the case on self-defense grounds.

But the judge has now denied that request. In June of 2024, Timothy Overton was accused of shooting and killing a 19-year-old in an apartment parking lot in Tea.

According to court records, Overton brought a gun and brass knuckles to this parking lot and set the gun inside his truck. Isaiah Morales confronted him, and the two men began fighting. According to the judge’s ruling, it appears that at one point during the confrontation, Morales put down his knife and told Overton he just wanted to talk.

Court documents also say Morales was not beating or punching Overton’s back; instead, Morales merely tried to restrain Overton from grabbing the gun out of his truck. A single gunshot to the head ultimately killed Morales…
