Defense attorneys have demanded the arrest of several members of Xavier Davis’ family to secure their testimony in his death penalty trial after they refused to come to court.
Judge Brian Warren appointed five lawyers unrelated to Davis’ case to represent the family members, including Davis’ father, brother, cousin and aunts, and give them one last chance to testify in his Harris County court before authorities set out to arrest them.
The witnesses, one of whom was served with a subpoena at his Humble apartment days earlier and another served at a H-E-B grocery store in Pearland, were ordered to court Monday, but none appeared, according to court records.
