Historical Context

Prior to this law, texting while driving was illegal in Florida but only enforced as a secondary offense, meaning drivers could only be cited for this if another traffic infraction was observed. The inadequacy of this approach became evident with the Department of Highway Safety and Motor Vehicles reporting nearly 50,000 distracted driving accidents in 2016, including 233 deaths. This alarming data prompted the Florida legislature to reevaluate and strengthen its stance on distracted driving, leading to the passing of this more stringent law.
