Florida’s New Law on Condo Association Parking: A Comprehensive Overview

Broward County, FL. — With many South Floirda condo assocations blocking owners and renters from parking their trucks and business vans in their own drivesways, residents have fought back with their legislators. Now, Florida has recently passed a new law that significantly impacts the rules around parking in condominium association lots and driveways. This law, which will go into effect on July 1, 2024, has stirred up a lot of discussion among homeowners and condo associations alike.

The New Law: What It Covers
The new law states that Homeowners’ Association (HOA) documents, including declarations of covenants, articles of incorporation, or bylaws, may not preclude a property owner or a tenant, a guest, or an invitee from parking his or her personal vehicle, including a pickup truck, in the property owner’s driveway. This means that homeowners or their invited guests can now park personal, business, or first responder vehicles (including pickup trucks) that are not commercial vehicles in their driveways or any other area where they have a right to park per state, county, and municipal regulations.
