Minnesota Republicans have filed a lawsuit against Gov. Tim Walz (DFL) over the coming special election in House District 40B, where the winning Democratic candidate was recently ruled ineligible over residency requirements.
On Saturday, the state Republican Party, along with conservative election integrity group Minnesota Voters Alliance, filed a petition Saturday, arguing that Walz acted against state election law when he called a special election in the district last week.
The reason? The groups say special elections in these cases can only be called 22 days after the beginning of the legislative session, which is scheduled for Tuesday, January 14.
“Issuing a writ that blatantly violates state law is a clear attempt to undermine our elections and harm our democracy,” said Republican Party of Minnesota Chairman Alex Plechash in a statement.
“The Democrats supported a candidate they knew to be ineligible for the seat, and now they seek to cover up their past wrongful actions by calling an unlawful and hastily scheduled special election.”
