LINCOLN, Neb. (KCAU) — An organization that opposes and looks to repeal Nebraska’s Opportunity Scholarships Act is defending the legality of its ballot initiative.
This comes after state senator Lou Ann Linehan is seeking to not have the initiative on the ballot in November. Support Our Schools Nebraska said the state’s constitution gives voters the right to repeal “any act of legislature” and that the measure must stay on the ballot. Attorneys for the organization said Linehan’s request should be rejected because it “exceeds the scope of your pre-election review.”

Support Our Schools Nebraska gathered more than 117,000 signatures and had their petition certified by the state’s secretary of state’s office. State senator Linehan released a statement in response to what Support Our Schools Nebraska had to say.
“The secretary of state is prohibited from accepting a referendum initiative that interferes with the legislature’s prerogative to raise the state’s necessary revenue,” she said. “This referendum does just that and should not be placed on the ballot.”
