Home Cultivation of Marijuana Soon Possible for New York Residents

The recent legalization of recreational marijuana in New York State has led to various developments, such as the opening of dispensaries and even a cannabis parade. Now, the possibility of home cultivation is being considered by the Cannabis Control Board.

The proposed rules would allow individuals over 21 to purchase seeds online or buy plants from licensed dispensaries. Home growers would be permitted to have six mature plants, six immature plants, and up to 5 pounds of flower. However, certain guidelines would need to be followed, such as keeping the plants in a secure location out of plain view. Growers would also be restricted to cultivating marijuana at a single location and federal law would still consider marijuana illicit, thus exempting individuals residing in federally subsidized housing or on federal property.

The board’s vote on these regulations, originally scheduled for January 24th, has been postponed, and a 60-day public comment period would follow if approved. The possibility of home cultivation of marijuana in New York State marks a significant step in the implementation of the recently legalized recreational marijuana.
