ODOJ escalates fight against Gable’s bid for compensation

The Oregon Department of Justice is continuing to fight Frank Gable’s request for compensation for being wrongly convicted and imprisoned for killing Oregon Corrections Director Michael Francke.

Gable’s conviction has been overturned by two federal courts, the original charges have been dismissed with prejudice, and a federal judge has ruled he cannot be retried for the crime in any court. Despite that, the department said it intends to depose Gable in his proceeding in Marion County Circuit Court seeking $2 million under an Oregon law that allows compensation to individuals who can prove they were wrongly convicted, and their convictions were later reversed by a preponderance of the evidence.

The announcement was made by Oregon Assistant Attorney General Michelle Enfield during a status conference before Marion County Circuit Court Judge Lindsay Partridge on April 22. Enfield also said the department intends to depose some witnesses in Gable’s trial who are still alive but did not name them.
