Thank you for letting me write to you briefly about some of the myths surrounding a “yes” vote on Referred Law 21 (RL 21) to uphold Senate Bill 201 (SB201). First, RL 21 has nothing to do with eminent domain. The authority to use eminent domain remains in statute, regardless of the failure or success of RL21. The bill in question doesn’t change one word of South Dakota’s laws that govern eminent domain, and the legislation didn’t even mention these two words. If you’re voting “no” on RL21, just don’t do it because of the belief that it will stop the use of this process for CO2 pipelines in South Dakota. It won’t.
