A Utica-area judge resigned last week as state investigators looked into allegations he drove with a suspended license and then mentioned his judicial title when confronted by police, according to the state Commission on Judicial Conduct.
Lee Town Justice Daniel Furney agreed he would not seek judicial office again in an agreement he signed Jan. 28 that effectively ended the investigation.
The documents released Tuesday by the commission said Furney was being investigated for driving despite having a suspended license and “gratuitously invoked his judicial office in separate incidents with two state troopers – once during a traffic stop, and once in a parking lot.” The document does not offer dates when the exchanges took place or say when the now ex-judge’s license was suspended…
