A Lithia man accused of opening fire on his neighbor during a heated dispute appeared in court for a status hearing, as prosecutors laid out details of a shooting that left one man injured and could send the shooter to prison for decades. Michael Kopel, 46, is charged with attempted second-degree murder with great bodily harm, aggravated battery with great bodily harm, and discharging a firearm in public or on residential property after allegedly firing 13 rounds at his neighbor.
According to WFLA, the confrontation began as a shouting match between Kopel and his neighbor before escalating into violence. The victim was reportedly walking toward Kopel from his own yard when Kopel opened fire, and the incident was captured on video. Kopel then left the scene and called 911, telling dispatchers he had shot his neighbor in self-defense. The Hillsborough County Sheriff’s Office arrested him, and the case was presented in court by the Hillsborough County State Attorney’s Office, which oversees the 13th Judicial Circuit.
Self-Defense Claim Clashes With Video Evidence
Kopel’s account to dispatchers has not lined up with the footage from the scene, according to WFLA’s reporting on the case. Under Florida’s Stand Your Ground framework, a person using deadly force must show a reasonable belief that it was necessary to prevent imminent death or great bodily harm, and prosecutors routinely lean on video evidence to dismantle self-defense claims when the footage contradicts a defendant’s version of events, according to Leppard Law.
That mismatch appears to be central to why Kopel is facing the most serious charge on the books short of murder. Under Florida law, attempted second-degree murder is ordinarily a second-degree felony, per Pumphrey Law.
