Attempted murder charge dropped after victim refuses to cooperate

Attempted murder and arson charges against a man accused of setting his girlfriend on fire last year were dismissed Monday after the woman refused to cooperate with the case, the Lucas County Prosecutor’s Office said.

Delvon Stone, 34, of the 1900 block of Barrows Street, had been scheduled to go on trial Monday for the alleged attack before Judge Lori Olender in Lucas County Common Pleas Court.

But prosecutors moved for the charges’ dismissal, and Judge Olender granted that request.

“The Lucas County Prosecutor’s Office did everything it could to try this case, but the victim did not cooperate with our team,” said Steve Slivka, a spokesman for the prosecutor’s office. “Every once in a while, we have a case that we can prove without a victim, and this is not that case.”

According to a police affidavit filed in Toledo Municipal Court after Stone’s arrest, the April 28, 2025, gasoline attack caused severe burns to the victim’s body, requiring multiple surgeries. The affidavit stated that Stone and the victim have one child together…
