A judge declined Wednesday to lower the bond for a Maumee man charged with murder in the death three months ago of a man he punched during an altercation in Side Cut Metropark.
Zachary Boyer, 34, through his attorney, Stevin Groth, asked Lucas County Common Pleas Judge Gary Cook to lower his client’s bond from $250,000 to $100,000 on the grounds that before his indictment last month, Mr. Boyer had appeared for all scheduled court dates related to the reckless homicide charge Maumee police filed when he was arrested for the death of John Meeker, 76, and that Mr. Meeker’s death was an accident.
Mr. Boyer does not have the means to post the higher amount, but he could probably reach the lower, Mr. Groth said.
While stating that Mr. Groth made some valid points, Judge Cook left in place the bond set during a previous court appearance.
During arraignment Tuesday for a refiled indictment, Mr. Groth entered not guilty pleas on Mr. Boyer’s behalf to all five counts against him: murder, involuntary manslaughter, reckless homicide, felonious assault, and aggravated assault. The first three counts represent alternative theories of the case, as do the two assault counts. The refiling occurred because one of the counts the original indictment included a mistaken reference to arson instead of assault.
