Mercy Health is fighting collaboration between Nationwide Children’s Hospital and ProMedica

Five years after announcing plans to form a partnership touted as a great fit for improving pediatric health care in Toledo, Mercy Health-Toledo is accusing Nationwide Children’s Hospital-Toledo of contract violations.

Nationwide leadership has responded by saying it is “surprised and disappointed” by what has been alleged in two Lucas County Common Pleas Court documents filed Thursday afternoon.

One is a 41-page lawsuit; the other is a 23-page amendment that supplements Mercy’s argument for a temporary restraining order. Much of what’s publicly available has been redacted for proprietary reasons, including eight full exhibits that are part of the lawsuit.

Mercy and its subsidiaries also name ProMedica Ebeid Children’s Hospital among the other co-defendants, as well as a group called Toledo for Kids, which refers to the newly formed partnership between Nationwide and ProMedica.

Rick Miller, Nationwide Children’s Hospital-Toledo president and chief operating officer, and Dr. R.W. Mills, Nationwide Children’s Hospital-Toledo chief medical officer, informed that facility’s staff and stakeholders about the lawsuit in a jointly signed two-page letter the same day of the filing.
