TOLEDO, Ohio — The city of Toledo plans to pay a man a $35,000 settlement after he was allegedly injured by a K-9 unit and then arrested during a traffic stop – in which his car was falsely flagged by a license plate camera – in 2024.
According to a Toledo City Council document, council will discuss on Monday whether or not to authorize the settlement, which was reached by the city and Brandon Upchurch, who sued the city in federal court. The city has agreed to pay the amount, but it is still pending council approval.
The lawsuit stems from an April, 2024 incident in which Upchurch’s vehicle had been falsely flagged as stolen by a license plate reader. Toledo police pulled Upchurch over, and ordered him out of his vehicle. He got out and began walking away and officers ordered him to the ground or they would release the K-9.
