A Tucson judge denied a motion to dismiss a criminal speeding case against state Sen. Justine Wadsack.
Tucson Magistrate Lisa Surhio on Tuesday denied a motion to dismiss Wadsack’s case and affirmed her trial would take place Dec. 23.
Tucson police allege Wadsack was driving 71 mph in a 35 mph zone in central Tucson on March 15. Wadsack faces a criminal speeding charge, a misdemeanor, and a civil charge of failing to produce to produce insurance.
Wadsack pleaded not guilty to the charges in September.
Wadsack was not immediately ticketed after the incident because she was a state lawmaker, and the Arizona Constitution gives legislators immunity from civil prosecution during the session. The session ended in mid-June.
“Members of the legislature shall be privileged from arrest in all cases except treason, felony, and breach of the peace, and they shall not be subject to any civil process during the session of the legislature, nor for fifteen days next before the commencement of each session,” the law states.
