HAMPTON, Va. (WAVY) — Cory Bigsby, the man accused of killing his 4-year-old son Codi Bigsby, appeared in a Hampton courtroom Tuesday morning for a hearing to determine if doctors can testify in his upcoming trial.
Bigsby’s defense team wanted two doctors to testify about more than whether he was mentally competent to stand trial.
However, Judge James Hawks agreed with the Commonwealth’s motion that the doctors should not be able to testify during the trial.
Judge Hawks accepted the Commonwealth’s arguments that other than determining competency anything else the doctors had to say would be irrelevant to the charges of murder and concealing a body.
Judge Hawks also denied a motion to reconsider a motion to suppress statements made by Cory Bigsby while he was in jail.
In November officers from the Hampton Roads Regional Jail read Bigsby’s written statements admitting that he beat Codi until he went into cardiac arrest, and he buried Codi’s body.
Bigsby’s attorney Curtis Brown became noticeably upset, raising his voice when the judge ruled against them.
