Chesapeake hospital seeks dismissal of federal charges related to Dr. Perwaiz case

CHESAPEAKE, Va. (WAVY) – In January, Chesapeake Regional Medical Center (CRMC) was charged in a two-count criminal indictment related to its alleged actions involving billing for Dr. Javaid Perwaiz’s performance of surgeries and other procedures at its facility. CRMC pleaded not guilty, and on Sept. 11, the Department of Justice announced there is a pending motion to dismiss the charges.

Chesapeake hospital indicted for healthcare fraud

The charges include healthcare fraud and conspiracy to defraud the U.S., as well as interference with government functions. As alleged in the indictment, CRMC granted privileges to Javaid Perwaiz from 1984 until his arrest in 2019, despite knowing that Perwaiz’ privileges had been terminated at another hospital for performing unnecessary surgeries. Dr. Perwaiz was also convicted of two federal felonies in 1996.

From 2010 to 2019, CRMC allegedly received $18.5 million in reimbursements from health care benefit programs for procedures Perwaiz performed at its facilities. In November 2020, Perwaiz was convicted on 52 counts of health care fraud, including performing unnecessary and irreversible procedures on women without their consent. He was sentenced to 59 years in prison.

Approximately 38 counts of the convictions were for procedures performed at CRMC, including unnecessary hysterectomies, elective inductions prior to 39 weeks of gestation without medical justification, and sterilizations of Medicaid patients without consent forms signed 30 days in advance…
