VIRGINIA BEACH, Va. (WAVY) — Charges against a former Cape Henry Collegiate student accused of making threats against the school were dismissed following his preliminary hearing Friday.
Malcolm Weathers appeared Friday morning before a judge on two counts of threatening to harm via electronic device in connection with a February incident in which he was accused of making threats against the school, a staff member and the school’s principal.
“It’s not our burden to prove that he didn’t send them. It’s the common law’s burden to prove that he did send them, and the evidence that they had to show he was the one who sent this email was entirely lacking,” said Mario Lorello, Weathers’ attorney. “There was no evidence that he was the one that sent the email.”…
