BELVILLE, N.C. (WECT) – The Town of Belville has asked a judge to throw out a lawsuit filed by the Town of Leland over a disputed land annexation, court records show.
Belville’s attorney, Norwood P. Blanchard III, filed a motion to dismiss on Sept. 10 in Brunswick County Superior Court. The motion argues the case should be dismissed with prejudice under Rules 12(b)(1) and (6) of the North Carolina Rules of Civil Procedure, claiming “no justiciable issue exists” and that Leland’s complaint “fails to state a claim.”
Leland sued Belville in June, alleging Belville illegally annexed roughly seven acres along Chappell Loop Road that sits closer to Leland’s borders than to Belville’s, in violation of N.C. Gen. Stat. 160A-58.1. Leland is asking the court to void the annexations and reimburse its court costs…
