Dunkin’ Discriminates Against Lactose Intolerant Customers With Extra Non-Dairy Charges, New Lawsuit Alleges

The lawsuit claims customers were overcharged for choosing non-dairy milk options due to lactose intolerance or milk allergies

Dunkin’ Donuts prefers people whose bodies can handle “real” milk — and it goes against the Americans with Disabilities Act — a class-action lawsuit filed in December alleges.

The lawsuit claims that Dunkin’ Donuts customers who may be lactose intolerant or have milk allergies may have paid up to $2 extra when ordering substitutions at the coffee giant.

The ingredients used for substitutions include almond milk, oak milk, coconut milk and others. These price increases could be deemed as discriminatory, Enica told NBC News .

In a report, the complaint was filed in Northern California and is similar to a 2022 class-action lawsuit filed by Bogdan Enica, who is also representing the 10 plaintiffs in the new filing.

The lawsuit was filed on Dec. 26, 2023, and included plaintiffs from Colorado, Hawaii, New York, California, Massachusetts, and Texas.
