Former Massachusetts FedEx driver gets 6 days in prison for selling firearms packaged for delivery

BOSTON (WWLP) – A former FedEx driver was sentenced to six days in prison for stealing and attempting to sell three firearms he took from packages he was responsible for delivering.

Frank P. O’Toole, 40, of Middleborough pleaded guilty to two counts of possession or sale of a stolen firearm. He was sentenced on Friday to time served of six days in prison, three years of supervised release, and 250 hours of community service.

As a FedEx driver, O’Toole stole three packages between October 2021 and June 2022 containing two rifles and a shotgun which he was responsible for delivering to a Federal Firearms Licensee. He then attempted to sell those firearms to an undercover agent on two separate occasions on August 9 and August 12, 2022.

The government had recommended a sentencing of ten months in prison.
