Audit finds misuse of NDAs and taxpayer money in Massachusetts

BOSTON (WWLP) – State Auditor Diana DiZoglio released an audit of non-disclosure agreements and confidentiality clauses across state agencies, and she says it reveals major concerns about these restrictive clauses in the Bay State.

This audit, the second such review of NDAs, shows that between 2019 and 2024, 21 state agencies entered into at least 263 agreements totaling $6.8 million in taxpayer dollars.

The auditor says the most concerning is a $1.375 million Massport settlement that used a confidentiality agreement to conceal alleged gender-based discrimination and unequal pay, among other allegations.
