BERNALILLO — A lawsuit against the ASK Academy in Rio Rancho is headed to trial next month.
Jury selection in the case alleging the charter school on Sundt Road did nothing to prevent a 12-year-old girl from being raped in a campus bathroom by an older male student in October 2021 is scheduled to begin on at 9 a.m. Aug. 17, according to a court notice filed on Monday. The trial is expected to last until Aug. 24.
The notice comes nearly a year after the lawsuit was reinstated. Since then, depositions of witnesses have been taken, and motions have been made to limit evidence that could be shown at trial. In addition, a motion for summary judgment — a judge’s ruling on the case before trial — is still pending…
