The City of Newark violated the Freedom of Information Act earlier this year when it denied a citizen activist access to minutes from closed-door meetings relating to the 2013 Data Centers LLC controversy, the Delaware Attorney General’s Office has ruled.
Now, the city has notified the AG’s office that it will not comply with the decision and added that if the office wants to compel the city to release the documents, it will have to file suit against the city.
“In the event reconsideration is not afforded and the AG’s office continues to require the city to disclose attorney-client privileged communications recorded in executive session minutes, the city will not comply and invites the AG’s office to commence litigation in order to compel compliance so that this important matter regarding a fundamental protection of law may be decided by the Delaware courts,” City Solicitor Paul Bilodeau wrote…
