LUBBOCK, Texas — Smoke shops and dispensaries around the Hub City are gearing themselves for another set of rule changes, which will ban any product that contains Delta-8, Delta-10, THCP, and other THC products effective July 31. The only legal smokable will now be ‘Delta-9.’
The latest development in the five-year long battle between hemp businesses and the Texas Department of State Health Services.
The new rules come after the DSHS brought back its 2021 definitions of “Tetrahydrocannabinols” and “Marihuana Extract” as controlled substances and a Texas Appeals Court rejected to lift the injunction that blocked the DSHS from carrying out the new hemp regulations, which got rid of the protection towards smoke and CBD shops.
