MOBILE, Ala. (NBC 15) — The Mobile County District Attorney’s Office is asking a judge to remove Precinct 31 Constable Albert McCreary from office, alleging his prior felony conviction and current residence in Baldwin County make him legally ineligible to serve.
The quo warranto petition was filed Thursday by the State of Alabama through Mobile County District Attorney Keith Blackwood’s office. It asks McCreary to show by what legal authority he continues to hold the elected position.
The filing comes as McCreary, 55, faces a federal charge of possession of a firearm by a prohibited person. Federal investigators say they found a loaded handgun in his vehicle while executing a search warrant connected to an investigation of a reported rape…
