Kentucky’s highest court has affirmed the 20-year sentence of an Ohio man previously convicted of beating another man to death inside a Lexington parking garage.
Benjamin Call, 41, was convicted of one count of murder for the October 2021 death of John “Ty” Abner after he was found unresponsive and covered in blood inside the Victorian Square parking garage.
Call previously requested the Kentucky Supreme Court reverse his sentence, saying that his level of intoxication — four times above the legal limit — and proof of acting in extreme emotional disturbance, should have resulted in acquittal by the trial judge.
