New Georgia HOA law raises foreclosure threshold, adds new protections

ATLANTA, Ga. (Atlanta News First) – Thousands of Georgia homeowners can sleep a little more sound in their ‘American Dreams,’ after the state’s first universal HOA rules become law.

Governor Brian Kemp signed the ‘Georgia Property Owners’ Bill of Rights Act’ (Senate Bill 406) into law May 12. The bulk of the law goes into effect in January 2027 to give the Secretary of State’s office time to set up the necessary staff.

The law addresses homeowners at risk of losing their homes due to fines for issues like not pressure washing their house or faded shutters. Homeowners who fight the fines often rack up thousands of dollars in court costs…
