Former Williamson County Sheriff Robert Chody and former Assistant Williamson County Attorney Jason Nassour have filed a federal civil rights lawsuit against prosecutors and local governments following the dismissal of criminal charges stemming from the 2019 death of Javier Ambler.
The lawsuit, filed in U.S. District Court in Waco, names Travis County District Attorney José Garza, Williamson County District Attorney Shawn Dick, assistant prosecutors from both offices, and Travis and Williamson counties as defendants. It alleges malicious prosecution, violations of constitutional rights, abuse of process, and other claims arising from a criminal case that lasted nearly six years.
Chody and Nassour were charged with evidence tampering after prosecutors alleged they helped prevent investigators from obtaining video recorded by the television show Live PD following Ambler’s death during a 2019 traffic stop.
