Upstate NY drunk driver pleads guilty to killing skateboarder, crashing into home, then fleeing scene

A 29-year-old Upstate New York man pleaded guilty Wednesday to killing a skateboarder in a drunk driving crash two years ago and then fleeing the scene.

Brian M. Borth of Tonawanda entered guilty pleas to one count of manslaughter in the second degree, two counts of vehicular manslaughter in the second degree and one count of leaving the scene of an incident. He was not offered a reduced plea and admitted to all counts in the indictment.

The incident occurred May 8, 2024, at approximately 12:40 a.m. on Niagara St. in Buffalo. Borth was driving southbound when he struck Allen Angel Ruiz, 21, from behind near the intersection of Fargo Ave. Ruiz was riding a skateboard in the southbound lane and was pronounced dead at the scene…
