The City of Buffalo is poised to pay $4.5 million to the family of Jose Hernandez-Rossy, who was shot and killed by a Buffalo police officer in 2017.
The proposed settlement resolves a federal lawsuit brought by Hernandez-Rossy’s mother, Marguerite Rossy, five months after Officer Justin Tedesco shot her son as he ran from the scene of a chaotic traffic stop during which Tedesco’s partner, Joseph Acquino, said he’d been shot and asked Tedesco to shoot the fleeing man.
Investigators for the state attorney general’s office later determined Hernandez-Rossy ”was not armed and did not shoot” Acquino, while also finding there was “no basis for criminal charges” against the officers…
