Attorney wants prosecutor removed from Sherman case

Cuyahoga County prosecutors are requesting an immediate hearing be held and that the court denies a motion that defense attorneys for Gregory Moore filed requesting that lead prosecutor Kevin Filiatraut be removed from the case.

Michael O’Malley, Cuyahoga County prosecutor, filed the motion in the Cuyahoga County Court of Common Pleas on Sept. 1 in response to an Aug. 28 motion filed by Jon Paul Rion of Rion & Rion, L.P.A., Inc. in Dayton, the defense attorney for Moore, the man accused of murdering Aliza Sherman of Beachwood.

Rion argued that Filiatraut colluded with Cleveland-based McCarthy, Lebit, Crystal & Liffman Co, LPA, Moore’s defense counsel in a separate case surrounding him allegedly calling in bomb threats to local courthouses to delay trials he was unprepared for, to prejudice Moore and that Filiatraut’s “ethical and constitutional violations” need to be looked into by an outside body…
